Title insurance in Miami-Dade and Broward
Short answer: title insurance protects you if someone later claims a right to your home, or if an old debt or mistake in the records shows up after you buy. You pay once, at closing, and you are covered for as long as you own the home. In Florida the price is set by the state, so it costs the same at every title company.
What title insurance covers
Before you close, we search the public records. But some problems cannot be found by any search. Title insurance pays to defend your ownership, or pays your loss, when one of them appears:
- A forged signature on an old deed
- An heir nobody knew about who claims a share of the home
- A mistake in how a past sale or mortgage was recorded
- An old lien or unpaid debt tied to the property
Owner's policy and lender's policy
There are two policies. The owner's policy protects you. The lender's policy protects the bank's loan, and your lender will require it if you have a mortgage. When both are issued together, the lender's policy costs only $25 plus any extra coverage the lender asks for.
How much title insurance costs in Florida
Florida sets the premium under Rule 69O-186.003 of the Florida Administrative Code. Every title company must charge the same rate.
| Coverage amount | Rate |
|---|---|
| First $100,000 | $5.75 per $1,000 |
| $100,000 to $1 million | $5.00 per $1,000 |
| Above $1 million | Lower rates apply |
On a $400,000 home, the owner's policy is $575 for the first $100,000 plus $1,500 for the next $300,000, or $2,075. What does differ between title companies is the settlement fee and how well your file is handled. We quote ours in writing before you sign.
Who pays for title insurance in Miami-Dade and Broward?
The buyer, by local custom. In Miami-Dade, Broward, Collier and Sarasota, the buyer usually pays for the owner's policy and chooses the title company. In most other Florida counties, including Palm Beach, the seller pays. The purchase contract can change this either way, so check which box is marked before you sign. See the full breakdown of who pays what.
What we do before we insure
We search the property's history, order a municipal lien search for open permits, code violations and unpaid utility bills, and issue a title commitment that lists anything that must be cleared. Then we clear it. Your policy is backed by our underwriters, First American Title and Investors Title Insurance Company.
Frequently asked questions
Do I need title insurance if I pay cash?
A lender's policy is not needed because there is no lender. An owner's policy is still strongly recommended. It is a one-time cost that protects your ownership for as long as you own the home.
Is title insurance cheaper at another Florida title company?
No. Florida sets the premium by rule, so the owner's policy costs the same everywhere. What varies is the settlement fee and the quality of service.
How long does title insurance last?
An owner's policy lasts as long as you or your heirs own the home. You pay for it once, at closing.
